Default Site eviction

My brother, who isnít as sensible as he should be, has not paid his site fees and the site owners have gone to court to have him evicted. The static is his only asset and he would need to sell it to pay the back fees and any other debts. Can the site owners just put his caravan on a trailer and move it away? In practical terms how will he be evicted? Any advice on solving this dilemma would be appreciated!

I think you will find the site can charge him a disconnection fee for the water, drainage, power etc and also charge him for costs of removal from site assuming he has somewhere to put his van once its back in his hands. If the van has no resale value, he can offer to just give it up & they can charge him for disposal fees. If the van has resale value, they may well offer to take it off his hands at a much reduced price because it would be a buyers market as frankly, your brother does not have anything in his favour. As I have seen before, if the van has resale value, they may offer him the chance to just sign away his rights to the van & walk away & the van which would then legally belong to the site they could resell to recoup their unpaid site fees & at least your brother would not be liable for disposal/removal costs etc. Your brother has a contract with the site owners to rent the land his van stands on and if that rent is not paid, technically, he & his van are trespassing on private land. All the cards are held by the site owners because your brother has not paid his site fees.

Don't think they actually have to take you to court to evict you if you havent paid its their right to move the van, the court would probably be for payment for disconnection removal of van from pitch which is usually a couple grand

Assuming it is a holiday static.
If residential, then a court order is required. The court will usually ask both sides to try and reach an agreement about paying back the arrears to avoid eviction, but if all routes are exhausted then the order to evacuate the site will be given.
